Effective Sept. 1, 2007, Local Rule 26.1 (Discovery) has been amended.
When appropriate, parties are encouraged to incorporate deadlines for the
discovery of Electronically Stored Information (ESI) into proposed
Discovery Schedules and now must include a deadline for the joining of
parties and for amending the pleadings. Sample discovery schedules
incorporating these changes are provided below for use by the parties.
Additionally, under the new rule, parties are afforded an additional 15 days
time in which discovery schedules may be filed – schedules will be due 45 days
(instead of 30) after the filing of the Answer or Third-Party Answer.
